General warranty conditions
FASADA company with its registered office in Warsaw at Al. Krakowska 173, hereinafter called the Producer, guarantees to the Purchaser of door and window joinery, made from PCV, aluminum, wood and also blinds, other accessories and additional equipment, as follows:
1. The Producer guarantees high quality and effective functioning of products which are covered by the warranty.
2. The producer issues a warranty for following time periods:

5 years for windows and doors made from PCV and aluminum, with exceptions stated below
-
5 years for wooden and aluminum-wooden windows, with exceptions stated below
-
1 year for wooden and wooden-aluminum doors
-
2 years for tilt and slide balcony windows and doors /PSK/
-
5 years for lift and slide balcony windows and doors /HST/
-
2 years for balcony folding accordion doors /FST/
-
5 years for composite glass tightness
-
3 years for paint coating of wooden windows and doors – solid and azure colors /bright or dark/
-
1 year for blinds and all kinds of additional accessories (door closer, sills, additional locks, sandwich panels, pulls, motorized controls for doors and windows, etc.)
3. The warranty period starts on the day of sale, visible on the sales invoice issued by the Producer.
4. Warranty rights can be exercised by the Purchaser after all of the due amounts have been paid to the Producer.
5. All entries complaint must be in writing, under pain of nullity.
6. The warranty covers:
-
latent, material and workmanship defects, which could not be detected on the day of purchase,
-
proper and permanent connections of all elements of products and their reliable functioning
-
delamination of composite glass and access of air or moisture to the interior.
7. The warranty does not cover:
-
defects and damage revealed during the purchase,
-
mechanical damage and defects in the form of cracks and scratches of products, including glasses, formed after their receipt,
-
defects and damage related to improper installation, transport, storage or use. Finished products in the form of windows, doors, blinds, insulated and single glass , packed on racks, should be stored in covered, dry, ventilated rooms, protected against atmospheric precipitation and direct sunlight, at a temperature not exceeding 40 ° C.

freezing, condensation and results of these phenomena, related to inappropriate climatic conditions inside the room, in which the products were installed,
-
damage caused by the use of cleaning agents or adhesive tapes, which negatively influence the layer of profiles made from PCV, aluminum and wood, fittings, glasses and seals, and cause scratches, pits or react with the paint coating,
-
products with changes in structure or products modified by unauthorized persons and without permission of the Producer
-
defects, which remain not visible after installation and do not affect the use value of the product (e.g. scratches on frames)
-
natural wear and tear related to the use of products,
-
damage arising as a result of building’s structural defects,
-
defects and damage related to the exceeding of technical standards and technical approvals resulting from the order, in which the Purchaser acknowledged the information about such excesses,
-
improper maintenance or its lack and improper handling or adjustment, also in relation to fittings, in case when they are covered with plaster or cement waste or other masonry materials,
-
products stored or used in rooms with improper ventilation, e.g. in environments with high humidity (>75%), what translates into the humidity inside the product >18% in color difference of specific elements of wooden products, caused by the deviation in shades of natural colors and graining of glue laminated wood, used in the production of joinery and also smaller defects which do not influence the use of the products. Described above deviations in colors, for specific stiles, during the photometric measurement, may reach up to 25% of deviation from the pattern, depending on the type and color of wood, thickness of applied paint etc.,

discolorations and differences in shades of wooden stiles and panels, resulting from natural properties of wood (differences between sapwood and heartwood, radial and tangential section) and natural changes in colors caused by the passing of time,
-
standard or non-standard properties of a product (single order) and quantitative lacks of elements or accessories revealed during the receipt of products,
-
structure of wood along the growth rings manifesting as insignificant roughness between late wood and early wood (rises in graining),
-
damage to paint coatings caused by reasons not attributable to the Producer (e.g. resulting from using improper adhesive tapes, using aggressive substances for cleaning, staining with fitting foam etc.),
-
intentional or unintentional maladjustment of fittings by the Purchaser or the user,
-
insignificant defects of the product or defects completely not visible after installation,
-
damage arising as a result of random events, not attributable to the Producer, e.g. flood, fire, burglary.
8. The Producer shall not be responsible for the correctness of measurements done by the Purchaser.
9. The warranty for fittings shall be issued under the condition that the Purchaser shall inspect (and prepare appropriate documentation for the inspection), maintain and adjust fittings at least once a year). The inspections, maintenance and adjustments can be performed by the window’s producer, installation crew or service and maintenance crew, which has signed service and maintenance agreement with the Producer. The documented inspections constitute grounds for acceptance of a possible complaint.
10. The warranty for wooden entrance doors installed on the Northern side of the facade is issued under the condition that the roofing shall be installed over those doors.
11. Quality evaluation criteria glass products
- The buyer is responsible for filling in the Acceptance Report about any noticed scratches, breakage or other mechanical defects of the delivered insulating glass units and/or single glass panes. Lack of such notes in the Acceptance Report may be the basis for rejection of possible complaints and other claims resulting from the presence of such defects.
- Glass quality evaluation methods
The insulating glass units and single glass panes should be evaluated according to the methods provided in the European/Polish Standards applicable to the specific type of
product. List of the standards below of them.
According to the above mentioned Standards, the evaluation of presence of defects is performed with the glass in a vertical position, from a distance of at least 2 metres, on a grey screen background, and with bright scattered lighting. Any glass defects visible in such conditions when observed at the right angle – are subject to evaluation for conformity with the requirements defined in the above mentioned standards. - Permissible glass defects in insulating glass units and single glass panes

- Glass soiling

Glass defects such as edge chips are permissible up to 2 mm or 20% of the glass thickness, while individual chips can be up to 6 mm. Cracks, even minor – are not permissible and should be reported at glass receipt. - Glass type
Any deviation from the glass product types specified in the purchase order is considered as a product fault. - Defects – Muntins / Georgian bars
Decorative elements can be installed inside an insulating glass unit at the buyer’s request. The type, colour, geometry of elements are according to the purchase order. The evaluation method regarding the accuracy and quality of these elements is the same as for the entire insulating glass unit – information above. From time to time, the decorative element may move within the unit, e.g. through opening or closing or when a heavy load vehicle passing by. In order to reduce the potential of damage to either glass or muntin, silicone spacer pads are applied as standard at the muntin junction points. - Spacer bar defects
The internal surfaces of the spacer bars should be clean. In standard insulating glass units the distance between spacer bar and a glass edge should not exceed 13 mm, and the variation of the distance from the glass edge at one side of insulating glass unit should not exceed 2 mm. - Loss of tightness
This is an insulating glass unit defect which occurs when the internal space between the insulating glass unit panes loses its tightness and allows gas and moisture exchange. A sign of such a fault is visible by permanent or periodic condensation on the internal surfaces of the insulating glass unit panes, or water collecting at the bottom of the insulating glass unit.
The standard warranty period for insulating glass unit tightness is:
– 5 years for rectangular shape insulating glass units,
– 2 years for non-rectangular shape insulating glass units.
The Warranty covers only the cases where the tightness was lost due to material or workmanship defects of the delivered insulating glass units, if the defects can be attributed to the producer.
It should be emphasised that only the water vapour condensation (dew) visible on the internal surfaces of insulating glass unit panes can be considered an insulating glass unit defect. Such dew cannot be removed by wiping the glass panes dry.
However, it is quite a common effect that water vapour condenses on the insulating glass unit surfaces towards the inside of the room or outside of the building – this is a natural effect which occurs when air humidity is high and the glass temperature is lower that of the ambient air. Such dew can be removed by wiping the glass panes dry.
The water vapour condensation on the external surfaces of insulating glass units is not considered as an insulating glass unit defect and is not covered by the warranty. - Product quality evaluation methods in European/Polish Standards:
- for insulating glass units: PN EN 1279-1 “Glass in building. Insulating glass units. Part 1. Generalities, dimensional tolerances and rules for the system description.”
- for toughened glazing panels: PN EN 12150-1 “Glass in building. Thermally toughened soda lime silicate safety glass. Part 1: Definition and description.”
- for glass panes made of float glass: PN EN 572-8 “Glass in building. Basic soda lime silicate glass products. Supplied and final cut sizes.”
- for glass panes made of coated glass: PN EN 1096-1 “Glass in building. Coated glass. Part 1: Definitions and classification.”
- for glass panes made of laminated glass: PN-EN ISO 12543-6 “Glass in building. Laminated glass and laminated safety glass. Appearance.”
- for glass panes made of heat strengthened glass: PN EN 1863-1 “Glass in building. Heat strengthened soda lime silicate safety glass. Part 1. Definitions and description.”
- for glass panes made of heat-soaked glass: PN EN 14179-1 “Glass in building. Heat-soaked thermally toughened soda lime silicate safety glass. Part 1. Definition and description.”
12. If products were damaged, the Purchaser should promptly inform the Producer.
13. The Producer is obliged to process the complaint within 14 days since its receipt.
14. If a complaint is accepted, the Producer is obliged to remedy the situation in one of the following ways:
-
removal of physical defects (repair works) in a case, when a defect constituting the reason for complain is possible to be removed according to the Producer’s assessment,
-
replacement of a product with another product which is free of defects, if revealed defects are not possible to be removed through repair
-
with the consent of the Purchaser, the Producer shall lower the price by an amount which corresponds to a use value of a product free of defects in comparison to a use value calculated based on existing defects. Lowering of the price, means automatic expiration of the warranty.
15. The Producer guarantees a maximum warranty repair period equal to 30 days. If there is a need to carry out complex repairs, the Producer reserves a right to extend the repair deadline. In case the timely removal of a defect is impossible due to unfavorable atmospheric conditions, the Producer shall complete his warranty obligation, after the conditions, which make the removal of a defect impossible in a way compliant with the technological requirements, will cease to continue.
16. The Producer shall not be held liable for any damage arising as a result of products use or damage resulting from inability to use a product, these also include a loss of profit, incurred losses and other consequential or accident damage. The Producer, also shall not be held liable for claims raised by the Purchaser or the user against third persons.
17. Any damages and defects which are not related to the Producer, may be only removed at the expense of the Purchaser/user.
18. If a complaint notification will be considered as groundless (e.g. defect shall not be considered as covered by the warranty), the Producer has a right to charge the Purchaser/Client with service and maintenance team inspection costs.
19. To all matters not settled herein provisions of Polish Civil Code shall apply. Any disputes will be settled first by negotiation. If no agreement is reached, the court competent to resolve the disputes will be the court competent for the seat of the Manufacturer.
20. The warranty is valid in the territory of the country to which the Manufacturer has directly sold its products. In case of export and the intra-community supply of goods orders, the Producer is only obliged to deliver spare parts in case of accepted complaint. The costs associated with the replacement of delivered parts are borne by the Purchaser.
21. Force majeure
If the perfomance of the contract or any of its obligations are impossible due to force majeure, the Producer is free from any liability for losses and damages caused by a non-performance of the contract or any of its obligations.
The terms “force majeure” shall mean an extraordinary event or circumstance beyond the control of the Producer, such as a war, strike, epidemic, industrial actions, riot, crime, or an event described by the legal term an act of God (hurricane, flood, earthquake, volcanic, eruption, etc.), which prevents one or both parties from fulfilling their obligations under the contract.
